The 7th Circuit recently considered for the first time whether an employee can be individually liable under a “cat’s paw” theory of retaliation under Section 1981. In Smith v. Bray the court held that an employee could sue an HR manager individually for retaliating against him by influencing the decision to fire him.

Can we request applicants’ Facebook passwords?

7th Circuit: Clothes-changing, travel time are not compensable

In Sandifer v. U.S. Steel Corp., the 7th Circuit held that an employer wasn’t required to pay employees for time spent changing into and out of work clothes and time spent traveling to and from the locker room and the work area.

7th Circuit: Under ADA, disabled don’t automatically get vacant job

Back in 2000, the 7th Circuit held that employers are not required to reassign disabled employees to a vacant position for which they are qualified. Although the EEOC recently challenged this position in EEOC v. United Airlines, Inc., the 7th Circuit held its ground, reaffirming its previous decision.

Every HR pro knows employers must pay overtime if an em­­ployee works more than 40 hours per week. But does an employer have to pay overtime if it doesn’t know or have reason to know that the employee worked overtime hours? No, according to the 7th Circuit Court of Appeals.
